Council Case Given To Court
Annapolis May 18 Lawyers for Montgomery County and a taxpayer argued the County Council may pass an unrestricted primary no party label act stripping party designations from council elections The Council earlier abolished party labels and faced judges who warned that a nonpartisan system might conflict with Maryland law The note also references a partial divorce and home rule constitutional issue.

Montgomery county charter reform rebuffed by courts
The court rulings say the amendment did not fully emancipate Montgomery County from the General Assembly. Adoption of the charter is not an absolute divorce but partial. The charter article allows council elections under public general law, with a potential non partisan vote to revise procedures. Ames and the county appealed after protests by election officials and the Democratic State Central Committee. Gerald D. Morgan filed to have his name on the Democratic primary ballot under the Lindsay Law of 1945, which aligns council nominations with party primaries and tagged ballots. The all Republican Montgomery delegation in the General Assembly has fought to exempt Montgomery from the Lindsay Law.

County Council backs opposition to election supervisors
Morgan MacDonald states the council acted to wipe out party ads under home rule provisions, allowing counties to shape local elections. He branded the Lindsay Law invalid and noted most Maryland municipalities run nonpartisan local elections to separate local from national issues. The Montgomery measure proposes a primary system with district picks and four at large leaders for the general election. A Junior Civic Club meeting is planned Monday at the Southern Restaurant with officer elections and a sewing program led by Doris Carpenter.
