Maryland Driving-License Suspensions Upheld by Supreme Court
The Supreme Court refused to hear Ernest Jones Jr.’s challenge to Maryland’s two track approach for drunken driving penalties. The court let stand administrative license suspensions alongside criminal prosecutions, a ruling Maryland officials say reinforces public safety. Jones, from Germantown, was cited for DWI in 1994 after a 0.27 breath-test result. his license faced a 3 day suspension in 1994, then a state conviction and jail term. The ruling allows continued administrative suspensions, with review by an administrative judge who can reduce penalties. Jones’ counsel may pursue federal relief if appropriate.
