Judge upholds dismissal of WWII seaman mustard gas suit
A federal judge in Richmond, Virginia rejected Nathan J. Schourman’s $5 million claim against the United States, ruling the suit was filed too late and violated military service injury doctrine. The 1944 Maryland mustard gas tests allegedly caused hearing loss, vision problems, brain atrophy, and other health issues. Schourman learned of potential causes in 1975, but only filed in 1978. The judge reserved judgment on Navy conduct, noting possible fault in secrecy and record-keeping but found the 34 year delay fatal to the case.
