Nontidal Wetlands Act Passed With Farm Exemptions
The Nontidal Wetlands Protection Act passed the legislature with time frames for implementation. The Department of Natural Resources must present adopted regulations and guidance maps on the first day of the 1990 session. Agricultural activities may be exempt if they do not drain, dredge, fill, or convert wetlands when not presently conducted, with further exemptions for public drainage, fallow areas, or set-aside programs. After Dec 31, 1990, most agricultural activities on nontidal wetlands require an SCWQ plan with three-year mitigation. The Agriculture Secretary may defer mitigation for economic hardship, and Soil Conservation Districts will delineate affected wetlands.
