Council Tells Contents Of Legal Opinion
The Montgomery County Council released a legal opinion by County Attorney Robert G. Rovin Jr. noting the council has latitude to fill a vacancy with any party member. The opinion cites no Maryland precedent due to charter gaps and contrasts with an earlier verbal view favoring a same party appointee. The vacancy arose after Democrat Jerry Williams died and Republican William C. Birely was appointed.
