Judge Upholds Abolishment of City Sanitation Division

Butler County Common Pleas Judge Fred B. Cramer upheld Middletown's abolition of the Division of Sanitation. He ruled city manager Dale Helsel could not conduct hearings in a related public employe strike, as injunctions and notices affected job terminations tied to a $1 million three year contract with Big M Trucking Co. of Miamisburg. He said the sanitation workers, about 25, were appointees under Civil Service law. He noted the city must permit a hearing by another official not tied to the firing.
