RULING IGNORED Man Freed From Jail

Butler County Common Pleas Judge Fred B. Cramer dismissed one habeas corpus motion to free a 36 year old Middletown man from jail and continued a second case for two weeks. The cases tested a Supreme Court ruling on appointed counsel for indigents charged with misdemeanors. The first involves Samuel W. Wilson Sr who argued he lacked legal representation at a hearing after a driving under suspension charge. Wilson had telephoned the court claiming indigence and was told counsel would be provided. Cramer suspended the remaining four days of Wilsons term at the suggestion of Area Two Court Judge William R. Hendrickson due to timing of the Supreme Court ruling and questions of indigence. The second motion concerns Frazier Moore who had 15 days left on a sentence after fines and payments. Moore was ordered released on bond and to seek employment while the case continues toward July 3.
