Nebraska killer Pope moves to be tried in state courts

Convicted bank robber killer Duane Earl Pope received a life sentence in federal court after the Supreme Court voided the death penalty. Within hours a move began to seek a state murder trial that could carry a death sentence. Deuel County officials argue a life sentence may not guarantee release, while federal law could allow Pope to be freed in about 11 or 12 years. Pope was convicted for a bank holdup that killed three people, occurring shortly after his graduation from McPherson College. A writ of habeas corpus directed Pope be brought to Chappell for state murder charges. Nebraska allows the death penalty for first degree murder.
