Judge Overturns Local Ruling In Hidalgo County case

Sixth District Judge Norman Hodges overturned a Lordsburg Magistrate Court ruling that found a local man guilty of electioneering near a polling place during the June primary. Morales, who ran for Hidalgo County Probate Judge and was defeated by Ena Mitchell, did not testify as witnesses described the prior warning by Officer Harris. The decision notes campaign literature may be present near polls but does not prove actual campaigning beyond reasonable doubt. The same judge also notes authorities will continue pursuing violations of election laws with similar facts.
