Death Stay Granted to Sex Slayer Rupp
In San Francisco federal Judge Edward P. Murphy granted a stay of execution for William F. Rupp, the Orange County rapist and murderer of Ruby Ann Payne, to review the habeas corpus case. The stay delays June 1 execution as Murphy cautioned a writ may not be issued, while defense attorney J. Zirpali argued Rupp lacked a chance to present a mental-derangement defense. Rupp’s sister Lois Schwinning, a UC student, wept at the news and has pressed for executive clemency with Gov. Knight. state aides contend the sanity issue was not properly raised in the appeals. Murphy stressed federal courts do not hear state appeals and signaled he would not overturn prior rulings without a strong constitutional violation showing.
