Justice Dept Sues ABA Over Ethics Code Advertising Ban
The Justice Department filed suit against the American Bar Association charging that its ethics code unlawfully bars about 200000 lawyers from advertising fees and services. The civil action seeks voiding of the provisions and an injunction against enforcing the code or forming new agreements in restraint of trade under the Sherman Act. The suit argues the code suppresses fee competition and deprives the public of information on availability and cost of legal services.

Supreme Court upholds mandatory retirement for police
The Supreme Court ruled 7 to 1 that civil servants may be forced to retire at a set age even if still able to work. An unsigned opinion upheld Massachusetts law requiring state police to retire at 50, the lowest retirement age for state police nationwide. The court held mandatory retirement does not violate equal protection if there is a reasonable basis such as presumed decline in physical ability with age.

High Court allows blacks in private schools
The Supreme Court 7-2 ruling upholds a Reconstruction Era act permitting blacks to attend white owned private schools in commercially run institutions with no church ties. Justice Potter Stewart rejected free association claims and affirmed the right of black students to enroll, while dissenters White and Rehnquist urged limits based on the act’s text and history. The decision clarifies private discrimination outside public schools remains unprotected by equal protection.
