Kansas death penalty retrial ordered over intellectual disability standard
The Kansas Supreme Court, in a 5-2 decision, ruled that post 2016 changes to death penalty standards require a new hearing to determine if Thurber was intellectually disabled under current law. Justices diverged on procedural issues, with dissents arguing for overturning the conviction or applying life without parole. Thurber remains on death row, as Kansas has not executed anyone since 1965.
