Federal Judge A J Mellott of Topeka refused to break the will of Augustus J Rice who died in 1926 and left 300000 to 500000 for Kansas schools including Kansas University and Kansas Wesleyan. Fifteen nieces and nephews contested the bequests claiming the provisions could not be carried out and that the will was void. The testator directed income from sale of land in Graham, Rooks and Lane counties be used to fund two local schools, plus a third trust for KU and Kansas Wesleyan. The judge found the schools ready to use the funds as Rice intended and found no evidence the will sought to bar narcotics use in treating disease.
