Turner's lawyers petitioned for a transfer from state to federal court arguing rights to free speech and public trial would be imperiled. Federal Judge Ben Krentzman said the move does not automatically stop the state case and would only negate state actions if granted. The trial had been delayed due to demonstrations outside the courthouse by about 600 Turner supporters. Turner was jailed for contempt after refusing to testify but was released on bond. The defense sought a venue change but was rejected by Judge Patterson before turning to federal court.
