Iowa ad tax ruled unconstitutional by district judge

Judge Nathan Grant ruled the 3 percent tax on advertising and the 56 service taxes unconstitutional. He found the law vague and discriminatory, treating interstate commerce without apportionment and permitting multiple taxation, while not restraining liberty of speech or the press. The suit was filed in Davenport district court by media groups challenging the tax.

Iowa builders sue over 3% tax on new construction

A representative group of Iowa builders filed suit in Des Moines challenging the 3 percent tax on new construction and seeking declaration that the entire service tax section of the tax bill is valid. The case centers on education, religious, and charitable institutions and sales tax collection at church bazaars and concession stands at high school events. William Forst, the revenue director, reversed the tax commission stance, saying the 3 percent tax does not apply to activities of education outside admissions. The state executive council voted to appeal to the Iowa Supreme Court, with a ruling not expected for months.

Builders Judge Grants partial ruling on tax provision

Judge Grant's decision limited challenges to the portion of the law that directly affects the plaintiffs while leaving about 55 other services taxed at 3 percent untouched. The ruling narrows the scope of potential litigation and clarifies the plaintiffs' rights to contest only the directly relevant tax provision.
