Transfer Law Referendums Ruled Invalid by State Supreme Court
Pierre, Sept 10. The state Supreme Court ruled petitions to refer laws transferring the inspections department and the motor patrol from the justice department to 40 other state agencies invalid. Governor Jensen won a writ restraining Secretary of State Wells from certifying the petitions for November vote. The decision covers both departments and follows earlier rulings on other petitions. The court invalidated thousands of signatures for missing residence data, duplicate signatures, signer misidentification, altered sections, and improper affidavits, concluding at least 7,103 signatures were invalid and the petition lacked required validity. The ruling notes no intentional fraud by circulators in some cases, but signatures could not be counted. The threshold for referral remains 14,696 signatures. In a related note, GM President Knudsen forecast 1939 auto production up 25-30 percent over 1938 with potential lower-priced new models.
