Roads Liable For Only Actual Cost
The U S Supreme Court ruled that railroads cannot be required to pay the full speculative value of lost shipments. In the Illinois Central v Mc Coy Fuel case, the court held damages must reflect the actual cost, not the retail value the coal would have fetched at destination. The decision settles that carriers’ liability for lost goods equals their actual cost, not potential profits or market price.
