Judge Refuses To Confirm Foreclosure Sale In Aberdeen
Circuit Judge W B Perry said he would resist a mandamus writ to show cause why he should not confirm a foreclosure sale in Marshall County. The case involves Langberg who bid 3500 on a 160 acre Dodds farm and seeks a deficiency judgment of 1224 plus accrued interest. The 1931 law against deficiency judgments and Dodds federal refinancing attempts are cited as grounds to protect farmers. The ruling emphasizes foreclosures aim to satisfy debt by the property value and the mortgagee must bid in full when value supports it.
