Indictment Challenges Grand Jury Evidence In Gwaltney Case
The grand jury faced no evidence to support Gwaltney’s indictment alleging bribe related poll tax gifts to influence votes. The solicitor admitted there was no legal evidence before the grand jury to sustain the indictment and that it rested on suspicion rather than legal proof. Mrs Griffin’s motion to quash claimed she testified before the grand jury and that the indictment stemmed from her testimony and the jury’s actions. The solicitor further conceded the defendant was subpoenaed and warned against introducing evidence to incriminate her.
