Legal Opinion Questions Governor Action versus Legislature Intent
The opinion notes the governor’s action does not alter Legislature intent and urges a practical approach to interpreting the 1947 general appropriation act. Justice Laveen challenges the majority, arguing the provisions must be read with conditions and purposes in mind. The case involves the Sonrene Court, court personnel conflicts, and a declaratory judgment over warrants and fund use. Judge Jones in Montgomery Circuit Court ruled the appropriations bill does not override old law and imposes no spending cap.
