State Supreme Court Reverses on Tax Penalties Redemption
The state supreme court, with Justice Stewart writing and all justices concurring except Chief Justice Sands, ruled a 24th assembly law allowing redemption of real estate by paying original tax plus interest or penalties violated state and federal constitutional provisions. The court held penalties are not part of the tax, challenging earlier rulings and noting the need to clarify legal principles despite emergency justifications.
