Montana Supreme Court Reaffirms Mining Locator Rules
In the Butte Consolidated Mining Co v Samuel Barker case the Montana Supreme Court on rehearing reaffirms that state code sections 3 611 and 3 612 govern quartz lode mining locations. Justice Holloway writes the opinion noting the state may require locator actions beyond federal law and that opening a cut crosscut or tunnel ties to the discovery shaft on the claimed location.
