Montana Supreme Court Limits Fence Laws on Trespass
The Montana Supreme Court ruling in Dorman v Eric holds fence laws do not authorize wilful trespass or shield owners who turn loose livestock to graze on a neighbor’s unenclosed land. Justice Farr writes that owners of unenclosed land cannot complain when kept at large livestock remain on public range, but cannot deliberately graze on another’s property without consequence. The decision, arising in Fergus County, clarifies that lack of a partition fence does not excuse intentional grazing trespass.
