Court decision on motorists shows jurisdiction rule
United Press reports a Philadelphia court ruling by Judge Hargest that minor Motor Vehicle Code offenses must be tried in the proper jurisdiction. The decision holds that if a case is brought before an improper magistrate or elsewhere, it must be dismissed for lack of jurisdiction. Keystone Automobile Club president Barton Works calls it a landmark interpretation of procedural provisions affecting speeding, reckless driving, defective lights, and felonies. The ruling emphasizes that jurisdiction can be challenged at the Court of Quarter Sessions regardless of initial path or waiver hearing.
