Supreme Court upholds jury over negligence in parked car case
In a split ruling the Nebraska Supreme Court affirmed a Custer County district court decision for La Vern Rosentrater in a suit by Elna Fleischer. The court said the question of contributory negligence and whether a stopped vehicle on the main traveled road is properly submissible should be left to the jury. Dissenting judges argued the statute does not bar momentary stoppage under proper circumstances.
