Nine opt out of Nebraska malpractice coverage law
Lincoln Nebraska M Berri Balka state insurance director says nine individuals have filed written exemptions under the states medical malpractice law enacted in 1966 but fully implemented three weeks ago after the Nebraska Supreme Court upheld it. The law sets a 500000 dollar cap on patient awards and creates four screening panels before court action. Balka notes it is unclear how many Nebraskans will opt out and says exemptions are being recorded individually. Parents can exempt children and spouses must sign when entire families opt out. individuals may also request exemption. Balka says few inquiries have come from doctors and hospitals about liabilities, adding most questions will go to the Nebraska Medical Association.
