In a most unusual situation the National labor relations Board was held properly to have found an unlawful discharge of the employees and such finding was approved by a United states court of appeals even though in an arbitration Case these employees were found to Haye been properly discharged. The court specifically held that an arbitration proceeding does not bar the National labor relations Board from having jurisdiction Over alleged unlawful discharges. The Norb had found that allegations submitted before the Board had not been submitted to the arbitrator for adjudication and that the issues in the Case did not involve interpretation of the contract.
