A judge will decide today whether scientists may testify in Franks case. The jurors remain in the room and a witness box will be locked toScopes' experts while the hearing weighs admissibility and scope of scientific testimony.
In Dayton Tennessee July 16 William Jennings Bryan and Dudley Field Malone argued for opposing aims in the Scopes trial. Bryan pressed biblical creation against science while Malone urged enlightened inquiry. The judge will hear scientist testimony next morning as the courtroom debates over the admissibility of expert witnesses continue.
German scientists and theologians condemn the Scopes trial and warn it ridicules the United States. They say evolution is not a crime, the Bible is not a natural science text, and church teaching should not be state commanded.
In Dayton Tennessee on July 16 Clarence Darrow outlined the defense stance on evolution arguing Genesis may be figurative and that life began as a single cell evolving into man. He said he is agnostic and would let witnesses explain their beliefs while the Bible story is not seen as inconsistent with evolution. The scene included cheering, courtroom tensions, and protests over opening prayers as spectators awaited expert testimony in the Scopes era trial.
Orville Harsley a 16 year old from Price avenue drowned in the Ohio River near Stop 1 Sedamsville while four companions aged 14 to 16 warned him to stay near shore. Fire department divers searched two hours but found no body due to strong current and snags.
President Coolidge may urge Congress to empower the government to operate coal mines in a worst case strike. Secretary Davis to report on negotiations while Coolidge considers using Hoover for settlement work. Public alarm grows as letters ask for a coal strike prevention and a published Coal Commission report is urged.
In Reedley California a home on a farm was destroyed by a blast that killed H. G. Schroeder and all four of his children Myrtle 24 Sarah 21 Louise 18 and Arnold 8. Mrs Schroeder was away in Kansas City and Edgar 17 was in a Fresno hospital.
Cadolini Rome police commissioner reveals twelve more missing diamonds from St Peter's loot, filling a golden chalice. Detective Marotta previously recovered part of the treasure, Cardinal Merry Del Val reacts with delight as Cadolini vows to seize the remaining sapphire and several diamonds and rubies. The exact method remains Cadolini's secret, but he states the diamonds were found in Rome.
A voluntary bankruptcy petition was filed for the brokerage Christian & Parsons in Chicago. Liabilities are about 650000 with assets around 500000. Dee Parsons, a firm member, was burned to death recently in his apartment under mysterious circumstances. a coroner's jury returned an open verdict, with his death blamed as a factor in the firm’s failure.
Washington July 16 Assistant Secretary Andrews of the Treasury advances with plans to form an effective enforcement organization for prohibition. He seeks twenty two top administrators and will tour the New York and Vermont frontiers to study border blocks. A two year study on industrial alcohol withdrawals is finished with rules to be issued July 22 and in effect August 1 when the reorganization starts.
Mrs Minnie Knueven, 62, of North Fairmount, was gravely injured when struck by a large sedan in front of her home late at night. Taken to Good Samaritan Hospital by witness William Weiss, she suffers a fractured skull and internal injuries. the driver fled the scene.
A London report credits Major von Tannenburg, aide to General von Mackensen, with guiding Abd el Krim’s Rift forces. An adventurous diplomat claims German officers and deserters from the French Foreign Legion are serving with the Rift army, recruited in the Rhineland and Ruhr for Africa.
Rev John T Bradner Smith of the World Service Commission says there is more church news and religious editorials in daily papers than ever. He spoke to pastors at Garrett Biblical Institute in Evanston and urged cooperation with newspapers while opposing dictation or propaganda.
New York July 16 rates for earthquake insurance on the Pacific Coast will rise two and a half times the present levels. Coinciding with the higher rates the co insurance coverage will be increased from 50 to 80 percent. The Executive and Rate Committees of the explosion conference of the Board of Fire Underwriters ordered the increase.
A nail from a lightning damaged spire of the First Universalist Church snagged the rope of a boat swain's chair, sending 18 year old Worcester steeple jack John Clancy 165 feet to his death as he fell through a passing motor truck roof.
In Kentucky near Richmond two boys aged 16 and 17 died instantly when struck by lightning as they took shelter in a tobacco barn during a storm. Two men, 33 and 35, were injured. one unconscious. Farmers had sought cover in a nearby barn after a hay field work when the bolt struck.
A July wind and rainstorm in Ohio killed Jeston Bartholomew a 45 year old farmer near Ravenna by heat exhaustion and leveled trees at Mantua while also killing Henry Clay a railroad worker at Marion. Lorain faced halted streetcar service and fears of repeat flood damage spurred cellar shelter as sewer blockages and property damage occurred in Bucyrus and Tiffin.
A near cyclonic storm struck Ironton and surrounding rural districts on July 16. The storm leveled barns silos and trees along a three mile stretch of the A P Highway. Roofs and chimneys were blown from farm houses and crops along river points were leveled. No loss of life reported.
A heavy wind and electrical storm swept St. Joseph County causing property and crop damage. Many trees were uprooted and telephone and telegraph poles along the Lincoln Highway for two miles were blown down. Estimated damage ranges from 75 000 to 100 000 dollars.
Henry Ford led bids of 1 706 000 dollars for 200 Shipping Board vessels to be scrapped, topping all offers except a skipped bid from Ocean Power Company. The Fleet Corporation will tabulate results and forward a sale recommendation to the Shipping Board this week amid protests from Boston Iron and Metal Company over the handling of the process.

More than 200 influenza cases reported at Ft. Yukon Alaska in a dispatch to national headquarters of the Protestant Episcopal Church. Bishop Peter Trimble Rowe said he would depart Dawson in a chartered launch with nurses and medicine to aid the stricken area.
Residents from Charlotte to Forest Lawn report renewed tidal waves on Lake Ontario following a June quake in Japan. At Forest Lawn the water receded about eight feet then surged onto shore, lifting driftwood, while lake levels dropped two feet before returning to normal. An earlier June quake was noted at Sodus Point. An Italian student had predicted shocks for today.
Swampscott Mass July 16 Charles D Hilles New York member of the Republican National Committee is the probable successor to Secretary Weeks if he cannot return to active War Department work. The President met Hilles for forty five minutes amid talks of an advisory role and a possible Cabinet appointment for a New York Republican. Paul Henderson resigned as Second Assistant Postmaster General.
In Chicago on July 16, Russell Scott, a 30 year old Canadian financier and alleged hoodlum, received a one week reprieve from Governor Len Small on the eve of his scheduled execution for the murder of Joseph Maurer during a drug store hold up. A Detroit telegram purporting to be from his brother Robert claimed sole guilt and offered surrender.
Dispatches report the Urubas tribe has attacked in Maranhao state, Brazil, killing four people and plundering farms in the sparsely populated coffee and farming district. Residents seek federal aid as state police are stretched.
Bucharest reports after a cabinet meeting the government plans to send an expert commission to the United States for preliminary talks on funding the war debt. Finance Minister Bratiano will visit Paris and London soon to discuss interallied debt with France and Britain. The American Legation has not confirmed any departure notice.
In Wilmington Delaware on July 16 Clayton C Whittington a farmer hanged a sixteen year old Black boy named Benjamin Knots in an attempted act related to his daughter A passing motorist cut him down and saved the boy The motorist alerted police who arrested the farmer Whittington was not held pending further inquiry.
United States Marshal Fritsch and Rochester deputies investigated the disappearance of 53000 in champagne from the Elmira New Jersey police station. The bottles were reportedly held for destruction and vanished yesterday, with no crew on duty at the time.
Governor Small orders a one week reprieve after receiving a Detroit message claiming responsibility for the shooting of Joseph Maurer. Secretary Sutton relayed the message to the governor by long distance and a special messenger will deliver the reprieve to Sheriff Hoffman in Cook County. Officials seek to verify the sender’s identity and origin of the message.
Western Union officials report a telegram to Governor Len Small of Illinois from "Robert Scott" asking to delay the 6 am hanging of Russell Scott. The message was handed to a newsboy on Woodward Avenue by a stranger who gave 50 cents for delivery to a Western Union office and could not be described.
Chicago dispatch reports Governor Small did not grant a reprieve for Russell Scott who prepared for death at dawn after a failed appeal. Scott, a Canadian financier and author, was set to hang for killing a drug clerk during a hold-up despite last‑minute pleas from his wife and father. The governor had refused to intervene, and Scott headed a large Canadian firm tied to an Detroit Windsor bridge project.
