Court rules tax moratorium act unconstitutional
Montana Supreme Court declared the tax moratorium act unconstitutional challenging SB 8 and chapter 41 of the 1933 session laws. The ruling states tax remission with no penalty or interest breaches the constitution and cannot be allowed to favor some taxpayers over others. The decision cites mandatory constitutional safeguards and notes the act was illegal at the time it was proposed. Senator Burr acknowledged delinquent taxes ran into millions and hoped the act could aid collections pending court review.
