The Supreme Court heard arguments on whether a South Dakota inmate from Iowa was improperly barred from early release for a drug crime involving a firearm. Christopher A. Lopez, convicted in 1997 of methamphetamine with intent to distribute, faced a 72 month sentence and a firearm enhancement. The 1994 law allows prison release reductions for non-violent inmates who finish a drug treatment program, but Lopez was denied due to a bureau rule excluding firearm crimes. Arguments challenged the bureau’s interpretation of the law’s discretionary language. Lopez is slated for release in June 2002.
