Lightner contract with Sisters Mercy upheld by Iowa Supreme Court
The Iowa Supreme Court upheld most of a 1927 contract between W H Lightner and the Sisters of Mercy to build a grotto and other structures on Mount Mercy grounds in Cedar Rapids. The court voided a perpetuality clause that would prevent mortgaging or selling the property without Lightner written approval, finding the remainder legal and commendable as it directed access, protection, insurance, and visitor access with a reasonable entrance fee.
