Polk County District Judge Ray C. Fountain ruled Iowa’s fair trade provision invalid for applying to merchants not agreeing to it and found state delegation of price setting to manufacturers unconstitutional. Bulova had sued Robinson wholesale firms in Des Moines and Davenport alleging below contract prices. The decision contrasts with 31 other states upholding similar acts.
