Police may not kill nonaggressive dogs on private property
A Texas court ruled Officer Garland could not kill a boxer dog that was not roaming or acting violently. The dog sat quiet in a garage when shots were fired. The court ordered Garland to pay Mr. White $1,000, noting only a vicious dog roaming at large justifies killing under imminent danger. The ruling hinges on public nuisance and necessity.
