Special to The Gazette Judge T H Goheen directs jury to verdict for defendant in a 25000 trespass suit filed by Leslie Lang of McGregor against W A Myers of McGregor The burn damaged oil station had been leased by the Milwaukee railroad to Lang who subleased to Myers After a fire the town ordered cleanup and the railroad canceled Langs lease Myers began cleanup prompting Lang suit.
Linn county officials investigated a pollution case after 14 dead hogs were found in a creek north of Mt Vernon on Tuesday. Merle Goudy Franklin township trustee and Supervisor Miles Sutera reported the scene while Deputy Sheriff Pete Whittemore investigated. Officials said the hogs may have been diseased and disposal of dead livestock is illegal. they must be buried or sent to a renderer.
The Linn county board of supervisors held a quiet session on two routine items. A May 19 hearing at 10 a.m. will consider vacating part of the Henry Pence Road one mile north of Alburnett, per a petition by G. E. Franson W. Steuber and F. W. Keller. The board also granted I. W. Stephenson of Center Point permission to place a pipe under a county road in Otter Creek township.
Stanley Neal Hancock, 34, of Keota pled guilty to a drunk driving charge. He was fined $300 and costs by Judge Floyd Philbrick after being arrested Monday night in Mt. Vernon when his car collided with two parked cars. Hancock appeared before Justice H. C. Dilley and was moved to Cedar Rapids for district court.
A jury in Judge Charles Penningroth's court found for the defendants in a damage suit. Raymond FE and Marilyn Roach won against plaintiff R. Gordon Walker. The counter claim for $332.52 was not awarded, and Walker had sought $639.41. The panel deliberated about 30 minutes.
Four lawsuits were dismissed by plaintiffs on Tuesday and Wednesday. The cases involved Interstate Training Service versus Paul Kautz for account, Schmitt and Henry Manufacturing Company versus Sam Abrams doing business as Abrams Furniture Company and Joseph J. Hronik Jr. versus Chicago Rock Island and Pacific Railroad for damage, and Dale E Nosek versus Dorothy A Nosek for divorce.
Albert McDonald, at large, waived a jury trial on an agrancy charge and received a four months suspended sentence in Linn County Jail from Judge Floyd Philbrick.
Henry Hawk 65 once Nebraskas famed prison lawyer and ex convict died in a Council Bluffs hospital Tuesday night after entering April 10. He gained freedom last year after 16 years for 1936 robbery slaying of Omaha grocer Isadore Perleman. His case went to the U.S. Supreme Court five times and a circuit court of appeals freed him a year ago.
Louis L. Maser aged 92 of Davenport died hours after being pulled from the Mississippi River. Two fishermen said Maser fell or jumped from a seawall. he was retrieved by net, given artificial respiration, and transported to Mercy Hospital.

Hugh Scott 52 of Grundy Center also injured with broken pelvis dislocated hip and internal injuries. Willard Archer a Nashua resident riding with Nicholas had a broken leg. Sheriff Meyer said Scott turned into the Nicholas car. both vehicles rolled onto their sides.
Max Harold Cook, 49, of Washington Indiana, died when the tractor he repaired and a semi trailer truck collided near Washington on highway 92. George E Franklin, 35, of Pulaski Indiana, drove the truck and struck the tractor as Cook tried to turn left. Authorities said Cook signaled before the collision and Franklin thought he was being signaled to pass.
Officer E. D. Benson aged 55, a state conservation officer for 16 years, died Monday night after suffering a heart attack. He collapsed while returning from a conservation meeting in Farmington.
Wes C. Jiras 47 of near Oxford died in an Iowa City hospital after a brief illness. He was born April 8, 1906 near Oxford and lived there all his life. Survived by wife Adelaide Sedlacek Jiras a daughter Carleen three sons Larry Jimmy Raymond six sisters three brothers and many relatives. Funeral 9:30 a.m. Thursday at St. Marys Oxford with burial in Mt Calvary cemetery Oxford. Rosary 8:30 p.m. Wednesday at Brush chapel Cedar Rapids.
Vesta I. Davis 77 died in a Cedar Rapids nursing home after a long illness. She lived at 1551 C avenue NE for 55 years and is survived by her husband Arthur W. Davis a son Glenn A. Davis and one grandson. Funeral 1 30 p m Friday Turner chapel with burial at Cedar Memorial cemetery. Flowers omitted donations to charity requested.
Charles F. Werba 81 of 1435 N street SW Cedar Rapids retired gardener died after an extended illness in a local nursing home at 11 45 p m Tuesday. Born July 8 1871 in Johnson county he married Mary in Iowa City Feb 2 1898. Survived by wife a son William three daughters Mrs James Zajicek Mrs Newel Hodgdon and Mrs Harry Mason all of Cedar Rapids a sister Mrs Mary Kroulik of Phoenix Ariz six grandchildren and three great grandchildren. Funeral at Barta Hesser chapel at 1 30 p m Friday with Rev Zdenek F Pauk burial Linwood cemetery. Friends may call after 4 p m Thursday.
Claude D. Cedar Rapids resident Albert C. Johnson aged 41 died Tuesday. Funeral services will be held at 2:30 p.m. Thursday in Chapel of Memories at Cedar Memorial Cemetery, with Rev. C. F. Olson of the Free Methodist church officiating. Friends may call at Brady mortuary until noon Thursday.
The war department reports U S casualties in Korea total 133 787, up 324 from last week. Of these, 23 757 are dead, 97 115 wounded, 2 365 captured, 9 156 missing, and 1 394 returned to military control. There were 63 additional deaths and 247 more wounded this week.

Henry C Doerzman 82, a landowner and noted hog raiser, died Tuesday after a long illness in a Marengo hospital. Funeral services will be Friday at 2 p.m. at St. John's Lutheran Church, with visitation at Hoover Funeral Home. He donated chimes to the church and was wheeled in for the first playing. His wife survives.
Elkader Iowa reports the death of three year old Janice Fischel daughter of Mr and Mrs Robert Fischel after a two week illness from rheumatic fever. Services were held Friday at 1 30 p m at home and 2 p m at Peace Evangelical Church with burial in East Side Cemetery. She is survived by her parents and a sister Jean aged 2.
Des Moines police report a cab driver from Mc Greevy Cab Company robbed of $20 by a passenger who demanded change at about 1 30 a.m. The same bandit had carried out two prior early morning robberies on Des Moines cab drivers, with the earlier attacks described as armed.
