Supreme Court upholds probate ruling in will dispute

In Errera, the Supreme Court sustains Judge Gilson ruling that former wills are not revoked when a later will is not produced but proven. The case centers on Mrs. Ploeser of $140,000 estate who executed a 1948 will revoking prior ones, while the 1916 will remained unseen in court and later destroyed. The 1924 will was produced and probate allowed despite challenges claiming revocation. The decision hinges on destruction of the later will and the validity of earlier instruments.
