Henry H. Rogers, the oil king, did not attend yesterday's Supreme Judicial Court session. His legal team Hemingway and Badger obtained a strongly worded opinion from Judge Hammond, described as more emphatic than recent court rulings.
Judge Hammond refuses to compel Mr. Rogers to appear, citing illness and risk to his health. The suit against Rogers and Pratt seeks royalties under contracts from 1874 involving Greenough oil refining. The case, once set for trial, was to be continued after testimony from a New York physician and Rogers’s lawyer.
Mrs Patrick McCarthy dies at her niece Eva McDonald’s home 146 Gerard Street Roxbury Massachusetts aged 106. The city notes her as one of its oldest inhabitants and pensioners.
Kate McDonald later McCarthy, born in the Scottish Highlands, aged 104 to 106, emigrated to North America via Canada, lived in East Bay and Sidney before settling in the United States. She married Patrick McCarthy, survived Civil War service by husband, relied on Uncle Sam and Massachusetts support, and remained active, smoking and moving without aid until shortly before death.
New York dispatch reports Cunard liner Lusitania faces competition on its next westward voyage departing Liverpool October 5 from Havre. The swift French liner La Provence will leave Havre on the same day, per unofficial sources.

In Canaan New Hampshire on Sept 16 the Boston Post identification of the body found in yesterday wreck as H D Stevens of Hartford Vermont was confirmed by his brother Arthur Stevens of Cambridge arriving late this afternoon. The body was transported to Boston tonight.
All twenty five victims of the Ganaan wreck are named, listing residents from New Hampshire Massachusetts Vermont Quebec and Texas. Names include Miss Annie Barrett Mrs Adolph Boisvert Leon Cady Richard Clarkson Delia Hould Augustine Royer Timothy Shaughnessey and others with addresses in Manchester Concord Lebanon Somerville and Boston.
New Hampshire officials announce no arrests will be ordered yet for the fatal wreck near Canaan as 25 people died or were injured in the collision of the Quebec express and a fast freight. Boston & Maine may pursue manslaughter warrants, but the Railroad Commission will wait for public opinion to cool before acting. The commission and railroad officials conduct an inquiry.
Putney states a thorough investigation will occur into the fatal accident. The three commissioners will wait while public sentiment cools, then visit Canaan for examination. Inspectors Armstrong and McGarr yesterday arrested Harlow H. Rogers aged 49 of 1812 Beacon Street Brookline on a warrant charging conspiracy and larceny for $8150 taken in July 1904 from Ernest Drew of Friend Street Roxbury.

Gertrude Alleyne aged 28 committed death by own action Sunday afternoon at 46 Norway Street Back Bay. She had long been a nervous invalid and recently appeared low. The death was not announced through official channels and Medical Examiner MacDonald declined to discuss the matter when contacted.
Murdock Dingwall of New Haven reports his sister Miriam Dingwall of Farmington wed Dr Kanichi Asakawa in Washington last week. Asakawa, 35, first Japanese Yale faculty member, chairs history of Japanese civilization. He met Miriam when a Yale student and later moved to Farmington.
Eloise M. Shields 18 of Milton battled a large hawk that assaulted her party at Blue Hills Reservation yesterday afternoon. She struck the bird with a tonic bottle after it knocked a pigeon from its talons, killing the hawk and escaping with minor scratches. Shields is a Milton High School student regarded as bright by locals.
