Gould Will Provision Questioned By Supreme Court Veteran Judge
A debate on Jay Gould's will provision arises as lawyers and a former supreme court justice dispute its legality. They argue the clause restricting marriage to certain unions may violate equity, public policy, and the estate’s entailed nature, risking judicial review and possible invalidation.
Opinion Declares Will Clause On Marriage Nexus Voids
Unofficially the will clause restricting the marriage of heirs is said to be contrary to public policy and void. James W. Gerard Jr. cites examples involving Howard Gould to argue courts would treat such restraint as an in terrorem device and not enforce it. The dispute centers on a man’s right to dispose of property in his own way and the executors’ authority.
