Bank Rights Question Sparks $25000 Damage Award

In Superior Court Judge Richardson ruled $25,000 damages for William Wiley against Bunker Hill National Bank. The dispute centered on whether the bank could apply a depositor's funds to an overdue note while a newer note remained unpaid. Wiley held $7908.50 on deposit, owed $5000 on an overdue note, and had a $7000 note not yet due. The bank offset $5000 from Wiley's balance and charged about $2900 to his credit. Wiley drew about $2700 in checks, which the bank refused to honor, prompting Wiley to seek damages claiming credit ruin and improper application of funds.
