Unconstitutional Child Labor Rider Struck Down by Judge
Federal Judge James F. Boyd declared the child labor section of the War Revenue Bill unconstitutional in Greensboro. He previously voided the original act after the Supreme Court ruling, and today made permanent an injunction stopping enforcement in a Charlotte factory. The 10 percent tax on interstate goods from factories employing under 14 or over 14 to 16-year-olds working long hours aims to regulate employment by taxation, which Boyd says invades state authority.
