Tax Commissioner to Test Constitutionality of Income Tax
The Massachusetts Supreme Judicial Court will hear a case challenging the 3 percent tax on net profits from stock market speculation. Tax Commissioner William D. Trefry has filed to compel Eliot T. Putnam of Milton to file a return for profits from 1916 stock sales and other alleged taxable gains. Putnam disputes the taxability of profits from rights sales and dividends as well as classifications under the constitution and the 44th amendment. The matter is expected to reach the full court.
