Policy rights to creditors pass over life policy to assignees
Warren S. Dame who assigned for the benefit of his creditors on Aug 7 1909 must surrender an insurance policy taken July 11 1898 to Charles P. Blinn and others as assignees. The Supreme Judicial Court ruled Dame holds valuable rights in the policy that pass to creditors despite his children being named beneficiaries if they survive. The suit by the children and the assignees to compel surrender and payment was resolved by ordering Dame to join and for the company to pay the policy value to the assignees.
