The First Interstate Decision Shows Gaping Holes in Act
Judge Deady’s ruling suggests the interstate commerce act has major loopholes. The Oregon California railroad could ship wheat to Portland then to San Francisco via steamship on cheaper combined rates, denying real effect of the law. The decision centers on continuous shipment and whether rates apply uniformly across segments.
