Court Instructions to Jury in Clayton Murder Case
The court advised the jury that self defense is affirmative but not required. the state must prove guilt beyond a reasonable doubt. If the jury doubts whether the defendant acted in self defense, conviction is improper. If the deceased harassed the defendant’s wife at the home prior to September 11, 1913, and the deceased kissed or caressed her, that invasion could justify the defendant’s protective force, including lethal force if reasonably necessary. The instruction emphasizes marriage status, home defense, and that honest and good faith use of force is required, not a shield for felonious homicide. If after all evidence the jury finds the defendant shot Joseph H. Stout mortally, they must determine if the act was in good faith self defense or defense of the home. otherwise acquittal is not warranted.
