Kanawha County Circuit Judge Herman Canady refused to block the Bacillus thuringiensis israelensis spraying plan, noting the state has invested enough to continue. He ordered the DNR to file a permit by July 1 to keep spraying on southern rivers, with a 30 day wait before a public hearing after filing. Critics warn ecological disruption from killing fly larvae.
