Widow Sues Vermont Railway In 66 Death of Robert Stratton
Mrs. Margaret Y. Stratton of Shaftsbury widow of Robert S. Stratton who was killed by a train in Sunderland on Nov 22 1966 has filed a 200000 suit in Bennington County Court against the Vermont Railway Company. The suit alleges railroad negligence claiming the southbound freight operator Chester Marsh failed to keep the train under proper control and stop. Stratton's death followed by the loss of their 18 year old son Donald. The suit argues pedestrians routinely used the track and that the engineer should have seen Stratton in plain view and slowed or stopped. The complaint cites that the accident occurred on a level straight track long used as a footpath with tacit railroad consent. The widow and three minor children claim loss of support and future pecuniary damages.
