Trust funds pass to Swett heirs after church dissolves

The Maine Law Court ruled a $5,000 trust left to the Bath Universalist church goes to two living heirs of Horace W. Swett, Lewis B. Swett and Lois Swett Earl, instead of the church. The decision reverses a Superior Court ruling that favored the Universalist church of Maine and centers on the need for an express general charitable intent for a trust to continue after the beneficiary ceases to exist.
