Higher Court Rules on County Creation by Special Act
The state supreme court held the legislature may create new counties by special enactment, thus validating Carter and Wheatland counties. Justice Lanner dissented, arguing prohibitory constitutional language still blocks such acts and warning that repeal of a general law by a special law is unprecedented. The majority dismissed the complaint and sustained the demurrer, allowing the Carter county act to stand.
