Governor Appoints to Fill Vacancy Prompting Legal Challenge
The article describes expected moves to fill a vacancy with a governor's appointee and possible ensuing legal actions. Chairman McLendon may file a quo warranto to determine rightful officeholder or seek a mandamus to compel state treasurer to pay his salary. Treasurer Brown sent the matter to Attorney General Hart, who has not issued an opinion. If the removed commissioner sues for pay, the attorney general would defend for the state.
