False Claims for Medicines Supreme Court Argument
The Johnson case opens a major test of the 1905 Pure Food and Drug Act. The government seeks to prosecute false statements about curative properties of drugs shipped in interstate commerce. Johnson's lawyers contend such statements are forecasts, not facts, risking criminal prosecutions by physicians and sellers. Solicitor General Lehman argues the act targets false remedial claims while not criminalizing licensed medical practice. Typewriters rented five dollars for three months by the American Writing Machine Company.
