Joe Wood testifies that Constable Edgar Mariner identified himself before the shooting on September 6 but Wood says he was blinded by a flashlight. Negro defendant denies saying officers could not search his shack and repeats motive was belief of being robbed.
Joe Wood testifies he was born a slave in Greenbrier County on March 14 1856 and owned by Joe Feist. The 70 year old man on trial for killing Constable Edgar C Mariner details his early life and river work on the Ohio River.
Horace Crammer, 70, testified that Wood had previously said he would not allow a city officer to search his home. Wood described his life from slave to Athens resident, and recounted the shooting after a warrant served at his door by Mariner and two others. He said he did not recognize Mariner as the man at the door.
A thirteenth man, James Hartley, is selected to serve as an alternate juror in the first degree murder case against Joe Wood. The alternate sits with the jury but has no vote, ready to replace any juror excused by the court.
